Ion Dragne, Managing Partner at Dragne & Asociatii, published an article in the Romanian Arbitration Journal no. 2/2012 titled “Provisional remedies – procedures started before State courts when an arbitration agreement was concluded”. The article looks at the role of the courts in supporting arbitration.
According to the author, the courts might intervene in the arbitration process from the beginning to the end as the concurrent jurisdiction principle is increasingly more recognized in modern arbitral legislation. The article provides an overview of the situations in which the court intervention is required prior or during the arbitration.
