We are honored to have successfully represented Băneasa Business & Technology Park SA and Băneasa Rezidențial SRL in a landmark case that spanned over 12 years of litigation and involved over 1000 parties, including Romanian and foreign companies, private individuals, financial institutions, and multinational corporations.
This high-stakes litigation revolved around the legal status of the land hosting key developments in northern Bucharest—such as the Băneasa Mall, Baneasa Business & Technology Park, IKEA, Mobexpert, and residential complexes—where claims by the State sought to cancel our clients’ property rights and revert the land to public ownership. These claims carried potential devastating consequences, threatening:
– The livelihoods of hundreds of apartment owners and employees in the area,
– The operations of businesses across the platform, and
– A combined financial impact of 1 billion RON in alleged damages.
We successfully defended the confirmation of private property rights over the land, culminating in a final decision by the High Court of Cassation and Justice on January 15, 2025. The courts definitively upheld that the land was not part of the public domain, leading to the full acquittal of all defendants.
