High Court Confirms the Annulment of the Precautionary Seizure Imposed on Viorel Micula’s Assets – An Important Win in High-Stakes Litigation

In 2025, ANAF ordered seizure exceeding RON 2.03 billion, later revised to RON 1.294 billion, in the context of the well-known state aid dispute initiated following a 2015 decision of the European Comission. The dispute concerns the enforcement and recovery implications of the 2013 ICSID arbitral award rendered in favor of the Micula investors under the Sweden–Romania Bilateral Investment Treaty.

In June 2025, the the Court of Oradea annulled the seizure decision, finding that the tax authority had failed to properly justify the necessity and proportionality of the measure and had committed significant procedural breaches in amending the initial order and individualizing the targeted assets. The High Court has now confirmed that ruling, bringing clarity and legal certainty in a matter of exceptional financial magnitude.
